Of the four criminal cases that Donald Trump is facing, the one now unfolding in Manhattan is generally considered the weakest. Worst of all, it doesn’t speak to Mr. Trump’s actions as president, as the other cases do. As a historian who has written about the wrenching events of the 1960s and early 1970s, I can’t help seeing Mr. Trump’s legal troubles through the lens of an earlier Republican president. But unlike Mr. Trump, Mr. Nixon never faced criminal charges himself. For that, justice suffered, and the nation suffered, too.

New York CNN —Jury selection in Donald Trump’s hush money business fraud case began Thursday looking like the task of finding 12 jurors had run aground. Juror 11 was seated on the jury after Merchan denied Trump’s challenge to the juror for cause. Former President Donald Trump's motorcade has arrived at the Manhattan courthouse where jury selection will begin for his hush money criminal trial. He's the first former president to go on trial for criminal charges. As in any state criminal court case in the county, the pool will be limited to people who live in Manhattan. Twelve jurors will make up the panel that will ultimately consider the 34 counts of falsifying business records against Trump. Six alternates will also hear the case in case a juror on the main panel needs to be replaced.

☆ Trump’s lawyers file another appeal in hush money trial

CNN —Lawyers for Donald Trump have filed another appeal in the hush money case to challenge the order by the trial’s judge denying him from arguing he has presidential immunity. Trump’s attorneys also are challenging Judge Juan Merchan’s “refusal” to recuse himself from the trial and a previous ruling related to how dockets are made publicly. In a brief two-page notice of petition filed on Wednesday, Trump’s lawyers alleged the judge exceeded his authority in those rulings and have asked the appeals court to hold a hearing on May 6. The court filing posted on the public docket does not indicate that Trump is seeking an emergency hearing before the appeals court to delay the trial in this notice of petition. Trump’s lawyers earlier this week asked the appeals court to stop the trial over pretrial publicity and the gag order.

With Judge Juan Merchan’s proclamation last week that jury selection in the Manhattan prosecution of Donald Trump will begin on March 25, it is time for a reappraisal of the case. Mr. Bragg will face tough challenges ahead, fueled by lingering skepticism that critics have harbored about the strength of the evidence and whether Mr. Trump has been unfairly targeted. To understand why this case matters, think about a precedent — an earlier episode of an election-related felony and its cover-up. That was the Watergate scandal, which hung over Richard Nixon’s re-election campaign in 1972. Because the investigation was unresolved, Mr. Nixon’s nefarious conduct worked — he was in the White House when the full revelations came out later, to devastating effect.

CNN —A Manhattan criminal court judge held entities of the Trump Organization in criminal contempt for not complying with multiple grand jury subpoenas dating as far back as October 2020 and three court orders mandating they produce the requested evidence ahead of their recent tax fraud trial. Judge Juan Merchan’s order requiring that the Trump Org. Merchan ruled at the end of the Trump Org. The Trump companies did produce thousands of pages of documents in the discovery process, the order said, but still failed to fulfill key requests from prosecutors despite the court orders. Lawyers for the Trump companies claimed they were noncompliant in 2021 because the subpoenas were vague and the time frame to respond was “unreasonably short given the scope and breadth of the demands,” according to the court order.
